1. Introduction and Binding Agreement

These Terms of Service (“Terms”) constitute a legally binding contract between you and Leatra Technologies LTD (“we,” “our,” or “us”) regarding your access to and use of the Anonime application, website, and related utility services (collectively, the “Service”).

By creating an account, initializing an identity profile ("Nym"), generating a "Whisper" thread, deploying a "Private Drop," or otherwise interacting with the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are accessing or using the Service on behalf of a business entity or organization, you represent and warrant that you hold the legal authority to bind that entity to these Terms. If you do not agree to these Terms, you are strictly prohibited from using the Service and must immediately discontinue access.

2. Corporate Status and Eligibility

The Service is owned, developed, and operated exclusively by Leatra Technologies LTD, a corporate entity legally incorporated under the laws of the Federal Republic of Nigeria.

To be eligible to access or use the Service, you must be at least 18 years of age and fully competent to enter into the terms, conditions, obligations, representations, and warranties set forth herein. If you reside in a jurisdiction where the legal age of majority or capacity to contract is greater than 18, your local laws apply. You assume full responsibility for ensuring that your use of the Service complies with all municipal, state, national, and international laws applicable to your jurisdiction.

3. Account Registration, Security, and Cryptographic Vault Keys

Access to the full suite of Anonime features requires the registration of an account. In establishing and maintaining your account, you agree to the following operational parameters:

  • Credential Security: You are solely responsible for maintaining the strict confidentiality of your sign-in credentials, authentication records, and JSON Web Tokens (JWTs).
  • Cryptographic Key Custody: Anonime employs client-side, zero-knowledge encryption. Your master Vault Key is generated and stored locally on your device. We do not transmit, view, store, or escrow your Vault Key on our servers. You hold exclusive custody of your Vault Key.
  • Unrecoverable Data Clause: If you lose, forget, or misplace your Vault Key, or lose the link keys to an individual Drop or Whisper thread, our servers cannot reconstruct them. Leatra Technologies LTD possesses no structural mechanism to recover your encrypted content or reset your keys. Lost keys result in permanent, irreversible data loss.
  • Account Liability: You assume full legal and operational liability for all activities, data transmissions, and feature usage occurring under your account, regardless of whether such activity was explicitly authorized by you.

4. Onboarding and Administration Records

To ensure proper infrastructure administration, compliance tracking, and abuse prevention, you acknowledge and agree that our infrastructure may generate and store immutable administrative records. These records include your explicit acceptance of specific versions of these Terms, your baseline onboarding milestones, system quota balances, and your cryptographic vault initialization statuses. These administrative metadata logs do not contain your unencrypted secret content.

5. User Content and Responsibilities

You retain all intellectual property rights and ownership over the data, text, files, and communications you upload, transmit, store, or distribute through the Service (collectively, "User Content").

You represent, warrant, and agree that you are solely responsible for:

  • The legality, integrity, and source authorization of your User Content.
  • Ensuring that you possess all necessary rights, licenses, and permissions to route, store, or transmit such content via our infrastructure.
  • Understanding the access risks associated with sharing unique Drop URLs, public aliases, or unauthenticated Whisper thread links with external third parties. Note that for Drops and Whispers, the decryption key is contained within the link fragment (the URL portion after #). Anyone possessing the full link can access the content.
  • Ensuring that your User Content does not violate any local laws, intellectual property rights, or the privacy rights of any third party.

6. Limited License Granted to Us

Solely to execute the technical operations of the platform, you grant Leatra Technologies LTD a limited, non-exclusive, worldwide, royalty-free, fully paid-up license to host, process, transmit, store, format, route, and conceptually display your User Content and associated metadata.

This license is granted for the strict and exclusive purpose of allowing us to operate, maintain, secure, and debug the Service on your behalf. This technical license terminates automatically when the corresponding content is deleted from our active database systems.

7. Intellectual Property Rights

Except for User Content, all rights, title, and interest in and to the Service, including the Anonime name, trademarks, software, source code, visual interfaces, documentation, and related intellectual property, are owned by Leatra Technologies LTD or its licensors. These Terms do not transfer ownership of any intellectual property rights to you. You may not copy, modify, distribute, reverse engineer, or sell any part of the Service without explicit written permission.

8. Zero-Knowledge Cryptographic Architecture and Limits

Anonime is structurally engineered to prioritize data minimization. While certain high-value data classifications are encrypted on your local device prior to hitting our network layer, you explicitly acknowledge and accept the following structural parameters:

  • Hybrid Sealing (Inbound Email): Inbound emails from external networks are encrypted ("sealed") server-side immediately upon receipt using a random key wrapped to your public key. While unreadable to us once sealed, the server briefly processes the plaintext at the instant of delivery.
  • External Email Interoperability (Outbound Email): Outbound email sent to recipients outside the Anonime platform is transmitted as ordinary email and is not end-to-end encrypted during delivery to the recipient. However, copies retained within the sender's Anonime account are encrypted and stored in a sealed format accessible only to the authenticated owner after unlocking their Vault.
  • Plaintext Designations: Customer support tickets, feedback forms, and inbound administrative communications sent directly to our staff are plaintext by design and are intentionally readable to allow for service delivery.
  • Infrastructure Quotas: To preserve system stability, we reserve the right to enforce hard quotas and limits on object-storage allocations, maximum file attachment sizes, API request rates, active session concurrency, Whisper thread durations, and subscription feature gates.

9. Free and Paid Service Tiers

The Service offers both complimentary feature tiers and premium paid feature allocations. Premium features subject to paid billing gates include outbound email sending rights, advanced Whisper thread creation, high-capacity Private Drops, and custom Nym configurations.

All tier allocations, usage pricing, and billing schedules are published within the active application subscription catalog or associated feature gate interface. We reserve the administrative right to adjust subscription rates, change feature gate classifications, or modify premium tiers in accordance with standard billing rules and applicable regulations.

10. Subscriptions, Payments, and Billing Networks

If you purchase a paid subscription or temporary feature allocation through the Service, the following billing terms apply:

  • Payment Authorization: You authorize us and our integrated payment processors (including Paystack) to charge the designated billing method for the explicit transaction amount shown at checkout.
  • Recurring Billing: If you select an auto-renewing term, you authorize recurring charges to be billed to your registered payment instrument until you formally cancel the renewal within your account settings.
  • Billing Failures: In the event that a payment transaction fails or is disputed, your access to the premium feature tiers or paid gates may be suspended or revoked.
  • Cardholder Data Security: To maintain PCI-DSS compliance, Leatra Technologies LTD does not store full primary account numbers or credit card CVV data on its infrastructure. All cardholder payment processing is handled securely by our vetted third-party payment processors.

11. Acceptable Use Policy

Your use of the Service is subject to the Anonime Acceptable Use Policy ("AUP"), which is incorporated into these Terms by reference.

You may not use the Service to engage in or facilitate unlawful, abusive, fraudulent, deceptive, harmful, or otherwise prohibited activity as described in the AUP.

Violations of the AUP may result in suspension, restriction, termination of access, removal of content, revocation of paid features, preservation of operational records, or other enforcement actions as reasonably necessary to protect the Service, its users, or third parties.

The use of Nyms, Drops, Whispers, aliases, or other privacy-enhancing features does not remove legal responsibility for your actions.

12. Content Moderation and Abuse Response

Because Anonime is designed as a privacy-focused platform utilizing client-side encryption, we are under no obligation to proactively monitor User Content. However, we reserve the right to review operational metadata, investigate network logs, or respond to third-party abuse reports. We may remove, disable access to, restrict, or preserve operational data or user profiles if we believe in good faith that such action is reasonably necessary to:

  • Comply with applicable law, judicial orders, or regulatory mandates.
  • Defend the platform, its user base, or our infrastructure vendors against immediate legal liability or cyber threats.
  • Detect, mitigate, and eliminate systemic fraud, network spam, or software vulnerabilities.
  • Enforce compliance with these active Terms of Service.

13. Lawful Requests and Disclosures

You acknowledge and agree that Leatra Technologies LTD may receive legal requests for user data from government agencies, law enforcement authorities, civil litigants, or judicial bodies. We will disclose operational metadata, billing records, routing logs, or encrypted data blobs in our possession if we determine in good faith that such disclosure is legally required under a valid court order, subpoena, warrant, or relevant legal process.

Because our architecture utilizes zero-knowledge client-side encryption for Vault items, Drops, and Whispers, you acknowledge that we have no technical means to produce decrypted plaintext variations of your locally encrypted data to any authority. We reserve the right to disclose operational data without notice if we reasonably believe, in good faith, that an emergency involving imminent death or serious bodily harm requires immediate disclosure.

14. Third-Party Infrastructure and Subprocessors

The continuous operation and availability of Anonime relies on integrations with third-party vendors, including infrastructure hosts, payment networks (Paystack), push notification networks (Firebase), and email routers (Mailgun).

You acknowledge and agree that these external providers operate under their own independent service terms and operational policies, which are entirely outside the control of Leatra Technologies LTD. We assume no legal liability for service interruptions, delivery delays, network failures, or API modifications caused directly or indirectly by these third-party subprocessors.

15. Service Availability and Operational Modifications

Leatra Technologies LTD provides the Service using a commercially reasonable level of care, but we do not guarantee continuous, uninterrupted uptime. We reserve the right, in our reasonable discretion, to modify, update, temporarily suspend, or discontinue features of the Service, where reasonably necessary for operational, security, legal, or business purposes, with or without prior notice.

The platform may experience temporary periods of unavailability due to scheduled database maintenance, urgent security patching, hardware upgrades, network congestion, or Force Majeure events beyond our reasonable control.

16. Privacy and Data Processing

Our data collection, usage, sharing, and storage practices are governed comprehensively by our Privacy Policy, which is explicitly incorporated into these Terms by reference. By accessing the Service, you acknowledge and agree that your operational metadata and personal data may be processed, managed, and routed in accordance with the terms of our Privacy Policy.

17. Security Model and Assumption of Risk

You explicitly understand and accept that no digital communications platform or cryptographic model is entirely invulnerable to exploitation. Leatra Technologies LTD does not represent or warrant that User Content will never be subject to unauthorized interception, exfiltration, alteration, or disclosure.

By using the Service, you accept all inherent risks of digital network transmission and assume full responsibility for implementing personal security controls, protecting your physical devices, securing your unique sharing links, and maintaining the strict confidentiality of your credentials and Vault Key.

18. Suspension and Permanent Termination

We reserve the right to suspend your access to the Service or permanently terminate your account, without prior notice or legal liability, if we reasonably determine that you have violated these Terms, engaged in fraudulent or abusive activities, failed to fulfill outstanding subscription payments, or exposed our infrastructure or users to material security risks.

You may initiate the deletion of your account at any time through the designated deletion mechanisms within the application interface. Upon execution, your account status will follow the definitive deletion protocols outlined in Section 19.

19. Data Minimization and Retention Schedules

To maintain our privacy-first and ephemeral-by-design architecture, information processed through the Service is subject to strict retention and deletion schedules. The Service is not intended to function as permanent storage, archival storage, backup infrastructure, or long-term communications retention.

Current maximum retention periods are as follows:

  • Inbound Email Content: Retained for a maximum of seventy-two (72) hours from receipt, after which it is permanently removed from active systems.
  • Private Drops: Subject to a maximum lifetime of seventy-two (72) hours. Drops may additionally be configured with a maximum read count. Once the configured read count is exhausted, the Drop is permanently destroyed and cannot be recovered.
  • Whispers: Subject to a maximum lifetime of seventy-two (72) hours. Threads automatically expire at the end of their configured lifespan and are permanently removed.
  • Support and Administrative Communications: Retained only for as long as reasonably necessary to provide support, resolve disputes, satisfy legal obligations, or protect the integrity of the Service.
  • Account Deletion: Upon submission of an account deletion request, the account is immediately disabled, rendered inaccessible, and scheduled for permanent deletion. Active account records and associated operational metadata are removed from production systems within seventy-two (72) hours. Account restoration is not available once deletion has been initiated.

You acknowledge and agree that:

  • Expired, burned, revoked, or deleted content cannot be recovered by you or by Leatra Technologies LTD.
  • The loss of a Vault Key may permanently prevent access to encrypted content protected by that key.
  • The loss of a Drop or Whisper link may permanently prevent access to content protected by that link.
  • Residual copies of deleted information may temporarily persist within encrypted backups for a limited operational period before automatic expiration and overwrite.

20. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. LEATRA TECHNOLOGIES LTD EXPRESSLY DISCLAIMS ALL WARRANTIES, CONDITIONS, AND REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT THE ARCHITECTURE WILL BE ERROR-FREE, SECURE, UNINTERRUPTED, OR INVULNERABLE TO CRYPTOGRAPHIC EXPLOITATION, NOR DO WE COMPLY WITH ANY IMPLIED WARRANTY REGARDING DATA PERMANENCE OR COMPLETELY AGNOSTIC ANONYMITY.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LEATRA TECHNOLOGIES LTD, ITS CORPORATE AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR INFRASTRUCTURE VENDORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA USE, CORRUPTION OF CONTENT, DATA LOSS DUE TO FORGOTTEN CRYPTOGRAPHIC VAULT KEYS OR LOST SHARE LINKS, DEVICE COMPROMISE, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO ACCESS THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS OF ANY KIND ARISING OUT OF OR RELATING TO THE USE OF THE SERVICE SHALL BE STRICTLY LIMITED TO THE GREATER OF: (A) THE TOTAL AMOUNT OF SUBSCRIPTION FEES YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) THE MINIMUM AMOUNT PERMITTED BY APPLICABLE LAW IN YOUR JURISDICTION.

22. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Leatra Technologies LTD, its corporate affiliates, officers, directors, employees, and operational vendors from and against any and all third-party claims, legal disputes, damages, liabilities, losses, costs, and professional expenses (including reasonable attorney's fees) arising out of or related to:

  • Your direct use, misuse, or deployment of the Service.
  • The nature, legality, or copyright compliance of your User Content.
  • Your violation of any section of these binding Terms of Service.
  • Your violation of any municipal, national, or international law, or the intellectual property or privacy rights of any third party.

23. Governing Law and Exclusive Jurisdiction

23.1 Governing Law These Terms of Service, and any legal disputes or claims arising out of or in connection with them, shall be governed by, interpreted, and construed in accordance with the laws of the Federal Republic of Nigeria, without giving effect to any principles of conflicts of law.

23.2 Exclusive Jurisdiction Any dispute, controversy, or claim arising out of or relating to this contract, including its formation, validity, binding effect, interpretation, performance, breach, or termination, shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction located in Lagos State, Nigeria. You hereby consent to and waive any objections to the personal jurisdiction and venue of such courts.

23.3 Class Action Waiver To the maximum extent permitted by applicable law, you and Leatra Technologies LTD agree that any dispute resolution proceedings will be conducted solely on an individual basis and not in a class, consolidated, or representative legal action.

24. Export Controls and Sanctions

You may not use the Service if such use would violate applicable export control, sanctions, or trade restriction laws in your jurisdiction or the Federal Republic of Nigeria. By using the Service, you represent and warrant that you are not located in a jurisdiction subject to applicable sanctions or trade restrictions, nor are you on any applicable restricted parties list.

25. Modifications to These Terms

We may update or modify these Terms of Service from time to time. Non-material changes will become effective immediately upon being published to the platform, with the updated timestamp clearly stated at the top of this document. Material changes to the Terms will be communicated via active platform notifications or administrative email and will become effective upon the date specified in the notice. Your continued use of the platform following the effective date of any changes constitutes an explicit and legally binding acceptance of the revised terms.
